Call to Order:

The meeting was called to order by Rick S. at 7:10 p.m.

Rick S. announced that the District 4 position was open.

Sheriff’s Report

Burglaries - 8

Auto thefts  -  3

Larceny -  5

Tom C. – some Renton officers make a big deal out of response time by Renton police compared to KC Sheriff; sometimes there’s a debate over which is the appropriate responder for issues on the plateau.  Rick S. suggested having Law & Justice committee (Dave Dahlin) to look into issues.

Motion to approve the minutes of the January Regular meeting as submitted was made by John V.  and 2nd by Betty F.  Rick S. mentioned that  the area under consideration for the school is the Winterbrook Horse Ranch area.

Edie J. reported that we had one $8.20 item processed.

 

 

Committee Reports

 

Tom C. wants to schedule a meeting to get a charter started.  He reminded us as to who was on committee (Tom, Rick, Edie, Eileen, Bob, Marshall).  He’ll send out an e-mail to the members.   Edie mentioned that we may have to make it public because of the size of committee.  It was discussed and decided that the meeting would be held at the Starbucks on Gilman Blvd on March 8 at 7:00 to 9:00 pm.  Because it is a public place, this should put us in compliance with the rules.

 

Main Topic – Comprehensive Plan

Gay Johnson (Assistant Fire Marshal, Building Services Division, DDES) explained that she was meeting with community groups regarding a proposal for banning fireworks in King County.  The County wants to know local concerns.  Last year was Renton’s first year of ban and there were no fireworks-related fires requiring response.  Most major cities already ban them.  In KC right now, fireworks are on sale from June 28 through July 4.  Cities that have enacted bans have fewer fires, incidents, etc.  A lot of cities are encouraging King County to pass a ban.  Many fireworks stands are on the boundary of cities so people buy there and take back into the city.  They feel a KC ban would help with that problem.  On Indian reservations, they sell fireworks that are legal in WA and those that are federally legal, but illegal in WA.  Those are suppose to be consumed on the reservation.  Last year Federal Way confiscated fireworks as people came off the reservation.  Bette F. asked if there could be designated areas for setting off fireworks.  Gay explained that no one wants the liability for that.  Two counties in WA have total bans (voted on by citizens) and the idea of a vote has been suggested to the KC Executive.

 

Rick S. asked about requirements for fire sprinkler systems for riding arenas.  Gay explained that the rules differ for a private family arena vs a public arena.  When you start boarding, having shows, auctions, having public in, etc, the codes are a lot different.  For a private family arena, you have to sign an affidavit that it’s for you and your family only.  Rick gave example of 4H, Future Farmers of America, etc that are more associations.  Those are considered public arenas.  The system has to be a dry (non-chemical) system.  Gay said that the rules have grown out of past experience with devastating fires with huge livestock losses.  The county has obligation to firefighters as well.  The current rules are not unique to KC.  She said that they will bring any recommendations back to us for comment.

 

Eminent Domain

Rod McFarland explained that the recent Supreme Court case said that “public good” can extend to economic reasons.  Rick S. circulated a paper by the Institute of Justice (they were involved in the Supreme Court case) that Rod felt was a very clearly written explanation of the issue.  The author’s opinion is that WA law gives jurisdictions more cover rather than less despite the general impression that it’s the other way around.  Just in last couple of days, the City of Olympia announced it is going to condemn the old Brewery (actually in Tumwater) in order to get water rights (if you don’t use water rights for 5 years, you lose them).  Governor Gregoire’s bill probably won’t be voted on this year (don’t think it made it out of committee on time).  Tom C. felt that if Growth Management laws are not subject to referendum by the people, then between that and eminent domain, people have no say regarding the taking of their property.  Rod McFarland mentioned a new concept discussed at the federal level that compensation would be some gross-up of fair market value (i.e. 25% add’l surcharge).  Bette F. said that her husband suggested that the assessed value should be considered the minimum offer price

 

Viet pointed out that there is a WA law (Urban Renewal Act) that says any takings will be based on economic development (this is where is “blight” defined).

 

Rural Economic Development Strategies

A meeting had been scheduled with Paul Reitenbach, Julia Larson, and her boss Ray Moser, but it was cancelled and is waiting to be rescheduled.

 

 

 

 

Other Business

 

Edie J. passed out the letter she sent on proposed wildfire regulations.  Dellanie to send soft copy to Tom to post on web.

 

Tom C. is drafting a document regarding inter-local between KC and Renton.  He is reviewing it with Viet in Reagan Dunn’s office.  He asked if we should we put FCUAC moniker on it?  Topics include funding for sub-area plans, land-use rules, legal issues faced by municipalities, staffing issues (planning depts), planning efficiency/effectiveness.  Rick S. suggested asking state legislators to provide for funding for this.  Tom C. and Viet are continuing to revise.  Tom C. is not sure what the next step should be:  Send to Renton?  Reagan advocate with Council?    Rick S. said that $10 million was set aside by County to assist cities on these annexation issues, but that the money has mainly been used for staff so far?  He asked whether there was any money left?  The group felt that is was not entirely clear what FCUAC’s role is on this, but Tom C. wants to keep FCUAC informed. On Monday, Renton voted to put annexation issue on ballot.

 

Marshall Brenden announced that May Valley is putting on its winter/spring potluck, Feb 27 at 6:00 pm at May Valley Alliance Church
